General terms and conditions
1) Scope
The following terms and conditions apply to all orders placed through this shop. This offer is only valid for private consumers.
A consumer is a natural person who enters into a legal transaction for purposes that are mainly neither related to their commercial nor their independent professional activity.
2) Contracting parties and conclusion of the contract
A purchase agreement is concluded with the placement of the order and receipt of payment from the contractual partner MAYAN. If payment is not received within 5 business days, the agreement will be cancelled.
3) Contract language and contract text storage
The language for concluding the contract is German. The data privacy statement and cancellation policy can be found under the respective headings.
4) Delivery terms & returns
In addition to the stated product prices, shipping costs of €4.99 (Germany) or €7.99 (EU and Switzerland) will be added. Shipping is via DHL with a tracking ID.
A return fee of €5.99 applies to German customers and €9.99 to EU customers. These fees will be deducted from the refund. Returns from Switzerland or the UK must be paid for by the customer. Any customs duties incurred are non-refundable.
In the case of a return, the original shipping costs will not be refunded.
The gift wrapping fee of €5.00 will not be refunded upon return of a gift set.
If the return is not packaged in its original condition, a packaging and restocking fee of €5.00 will be charged.
If the order was originally shipped free of charge and is returned, a flat fee of €4.99 (DE) or €7.99 (EU + Switzerland) will be charged for the refund.
Returns from Switzerland must be paid for by the customer.
In the case of a partial return that reduces the order value below the threshold for free shipping, we will charge the original shipping costs of €4.99. Similarly, the discount will not apply in the case of a partial return if it was tied to the purchase of a specific number of items.
The customer has the right to return the goods within 30 days of receipt. Returns must be registered in advance by email or via our return process. If a return is made without prior registration or after the 30-day return period has expired, there is no entitlement to a refund.
After cancellation, the customer must return the goods within 14 days (§ 357 para. 1 BGB); if this deadline is exceeded, Mayan is neither obliged to accept the goods nor to issue a refund.
In the event of a full or partial cancellation of the purchase agreement, the customer is obligated to return all free gifts received as part of the order. If free gifts are not returned, we reserve the right to deduct the corresponding value of the goods or invoice them separately.
5) Undeliverable shipments / Returns due to failure to accept delivery or incorrect address information
If a shipment cannot be delivered for reasons attributable to the customer and is returned to us (e.g., due to failure to collect it from the post office/parcel locker, refusal of acceptance, incorrect or incomplete name or address information), we reserve the right to cancel the purchase contract.
In this case, the customer will be charged for the original shipping costs and the return shipping costs, or these will be deducted from the refund. The goods will only be resent after the customer has paid the shipping costs in advance.
Further legal rights remain unaffected.
6) Payment
The following payment options are available to the customer:

7) Retention of title
The goods remain the property of MAYAN until full payment is received.
8) Transport damage
Should any transport damage occur during transit, it must be reported immediately to the delivery company and the seller must be notified. Failure to do so will not affect the customer's statutory or contractual warranty rights.
9) Warranty, guarantee and custom-made goods
The statutory right of return applies to clothing if it is defective and unless expressly agreed otherwise. If a defect is found in the garment, the buyer has 30 days from receipt of the goods to exercise their right of withdrawal.
Please note that only unworn, unwashed and originally labeled goods can be returned.
The buyer always bears the costs for a return shipment.
Shipping costs incurred will not be refunded.
10) Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
The seller is not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
